GMAC Mortgage Forecloses on the Disabled

I have been documenting my experience as a 52 year old Slidell, Louisiana woman who is disabled and trying to acquire assistance with housing with an eviction looming from GMAC Mortgage.

My husband and I taped an interview with "Action Reporter" Bill Capo, from WWL-TV Channel 4 (New Orleans). On Thursday, June 16th, 2010, this feature aired on the 10:00 p.m. news. This whole interview took about 3 hours to complete. I was able to tell my story in its entirety to Mr. Capo and he was ready with all the right questions. Of course, it was edited and much of our lengthy interview was omitted due to the constrictions of television. The edited result can be viewed on line at the WWL-TV web site under "Action Reports".

Our foreclosure took place on April 28, 2010, right after we celebrated our 8th wedding anniversary. Now we await the forthcoming eviction notice from GMAC Morgage...any day now.

I began my research after the sheriff came to our door in January of this year with a foreclosure notice from our mortgage company, GMAC. Since then, my efforts are continuing to learn about my options as a disabled individual and trying to find programs that could save our home. We knew there were programs out there, and we trusted GMAC to submit us to any programs that may assist us in keeping our home.

We provided our income information to them as soon as the foreclosure process began. The sale of our home was set for April 28th, 2010. On the 27th, GMAC informed us they needed more information. My husband scrambled around to fulfill their request, faxed 9 pages to GMAC, and then called to confirm that GMAC had received the information.

The next day, we were told that we were "denied" by everyone and we lost our home. I was a little suspicious, as they certainly didn't have enough time (literally overnight) to submit us anywhere. I have repeatedly asked for the documentation of who they submitted us to and why we were denied, to no avail. One day, I got Mary on the phone from GMAC. She informed us that we were never submitted to anyone...so there was no denial! Conveniently, she did state that they had received the paperwork they requested, but it was dated the 29th--the day after the foreclosure! We knew that we provided this on the 27th.

The funny thing is, Mr. Capo spoke with the attorney representing our mortgage company, GMAC. She confirmed that our home had been foreclosed on and we will soon be evicted. Mr. Capo asked what will happen to our home, will it be put up for sale? Her answer shocked him--our home is becoming a HUD home! He has suggested to all parties involved that we be allowed to stay put and has now reached out to HUD about this situation. We'll see...

This email was sent to everyone in my address book, asking for my story to be forwarded to everyone they know. And it was sent to any federal, state and local government offices, and every organization that I could find that deals with advocacy, disability issues, and consumer affairs. I also contacted our local media, as well as newspapers, magazines, talk shows and news programs nationally.

At the age of 52 and disabled, I am facing homelessness. Thanks, GMAC.

This company is the worst company that any individual could get involved with-if considering GMAC-dont!!! Run the other way, if you are sold to GMAc as we were-do whatever you can to refi. This company has done nothiong but give me the runaround(thats when I actually speak to a person-who I can understand) about my loan mod. my hours as well as my husband were cut-at the same time our mortgage payment went up sapposedly due to a shortage in our escrow-we immediantly faxed over all the documents thye needed for a loan mod. I was told they would contact me in 10days to let us know if they needed more info. I called nearly every day for 2weeks jst to chk up on it-they never said they needed anything else, jst that it was being reviewed. One day I called about 3 weeks after after everything was faxed-they said why havent you faxed over your bank statements? WHAT?!? they said they had everything, plus I never recieved a phone call saying they needed new info. They kept saying we needed to try and make our payment whilke the loan mod was being processed-we made one payment and now our not 30 behind on our mortgage (we will be)anyway they are now saying it will take 30 more dyas to hear anythign about the loan mod...plus....we all of a sudden dont qualify for immediate help because we did what they asked and made a payment-though we still owe 1600!!! they will not trnasfer me to loss mitigation, allow me to tlk to a manager, or tell me who my actual loan holder is!!! this company is trying to take my house-I believe nothing less. they are rude, ignorant, and completely fruadulant!! stay away from gmac!!!

We purchased our home in 2006, and unwittingly agreed to finance it using an option ARM type mortgage. Eventually, our mortgage was sold to GMAC.
Obviously, ARM loans are not ideal type loans in a recession, so to avoid an interest rate hike, we approached GMAC to try and ask for a loan modification. This is an important detail....we were current, and were not in danger of any type of foreclosure or default.
Like many consumers, we have sparkling credit, and have never been late and have never missed a payment. As part of GMAC's loan modification (which took nearly 6 months, and dozens upon dozens of phone calls and lost paperwork), we were set-up with a 90 day trial loan. During that 90 day trial, we were told to pay a lesser monthly payment, and after the 90 day term, GMAC would decide if the new payment and terms fit for us.
In the second month of the trial, GMAC STOLE an extra payment from our bank account with no authorization. When confronted, they said it was our fault for not turning off our auto-payment option (we had), and that they recommended we not ask for a refund because we had qualified for the modification. We just had to wait another few weeks to receive our paperwork, and we could forget all the problems.
Weeks later, we received a denial letter, and a demand for payment stating that we were now in default and owed them payments for several months, including the months they took two payments from!!! The day our denial letter showed up, someone came to our house to photograph it. Remember....we have never missed a payment, have never been late, and our ARM has not matured.
Their customer service department is a joke, and is designed to discourage consumers from fighting for their homes. Even their supervisors supply you with no real answers. In regards to the extra payment they stole, NO ONE AT GMAC COULD EXPLAIN THE WITHDRAWL, OR THE AMOUNT THEY TOOK!! The amount didn't even match the trial amount, or any of our option payments!!
GMAC IS COMMITTING FRAUD EVERYDAY!! THEY ARE STEALING OUR PROPERTY AND MONEY, AND I REFUSE TO LET THEM.

I have never experienced so many problems with one company in all of my life.
First, to date we have never been late on a payment. Although they are trying to force that situation as well.
In late 2008, GMAC sent me a letter stating that out escrows were short $1400.00. Talk about dumb, despite their math being wrong, I paid it to make the vultures GO AWAY! With the demand that this not happen again. Well, guess what.. They came to me this year with their hand out for $700.00 in shortages. NONE of which exist, there were never any shortages. Not that I am able to find, my numbers, show a large surplus in escrow cash. So I sent in this months payment, only to find out TODAY, the last day in the grace period that they "haven't applied it yet" because it's short 59 dollars. They didn't call me, they didn't tell, I found out on my own. Those animals were trying to draw late fees, and make it so I can't re-fi away from them.
Got news for you scum bags, I am buying my way into a re-fi with my CU, taking an interest hike, all to get away from such a HORRIBLE company. May only the worst fall upon such a nasty company.
gmac, a train wreck for refinancing

They took 5 months to review my refinance, constantly wasting time by asking for new documents as the old ones expired while they were wasting time. In the end, they rejected the refinance as I was "a credit risk." My credit score was 770, mortgage 108,000 on an appraised home of 152,000. Is it just me, or is it odd that they rejected the refinance on a loan they already owned?

I am beginning to think GMAC is just a criminal enterprise. I believe they don't actually own the notes on a lot of mortgages and are illegally foreclosing on homes. Their customer service reps are condescending and just plain ignorant. Never a supervisor in site. They receive OUR taxpayer bailout money and then won't help us keep our homes. They make me sick.

My husband acquired a disabling condition a year ago and we attempted to refi to lower the payments thru the mortgage assistance program. First, GMAC told us to go to 21st Century Legal whom were to charge us a hefty fee for the assistance while still paying our regular mortgage. Then the legal service was seized by the FBI for their misdealings. NICE!!! After this fiasco, GMAC told us since disability payments are not considered permanent income we could vacate the premises and give them the keys to the house after living there 11 years and never late on a payment. NICE!!! No assistance from them whatsoever, only discrimination.

In 40 years of dealing with mortgage companies, never have I witnessed such POOR customer service. The reviews are "dead on" and the attitude from the reps is "tough sh*_*". The hold times and transfers - the worst. Finding someone with common sense - forget it. Finding a manager or supervisor, sorry, they all have their heads up their collective arses! Everything they tell you is scripted. The freaking place wreaks of corruption and deception.

Currently experiencing the need to "short sell" a second home, due to job move. After two years of trying to keep up, I gave up. Tried to work out a deal to keep both homes - GMAC is not interested in helping or finding solutions. THEY SUCK - THEIR PERSONEL SUCK - THEIR MANAGMENT SUCK and THEIR POLICIES SUCK. If you are considering a loan from GMAC - run like HELL and do not look back - deal with the devil is safer and I am certain he is more compassionate. This company cannot be owned by US interests..... can it?

I have been trying to resolve a problem with my escrow account with GMAC for over 2 months. 30 emails and a half-dozen phone calls later, I've concluded it would be easier just to refinance. I would PAY EXTRA to never have to deal with GMAC's customer disservice department again.
